The Public Technical Gazette Published By the Korean Industrial Property Office

In order to prevent the applications of the industrial property right for the purpose of the simple defense, the Korean Industrial Property Office (KIPO) will inform early the developed technology to the public.
Accordingly, it is expected that the following applications by the rival companies will decrease drastically.
The Korea Invention Promotion Association, an affiliated organization of the KIPO will publish about two hundred copies of "The Public Technical Gazette" every month from July, 1998 which comprises of technical information.
In the Public Technical Gazette, there will be titles of technology, the name of the company, an international patent classification, the developer, contents of the technology, the drawings and so on.
At the end of the year, the Public technical gazette will be produced in the form of CD-ROM and this information will also be provided via the internet.
According to the introduction of the public technical gazette system, the KIPO expects that the applications for simple defense will be reduced, so that the back log of examinations will be able to be processed.
In addition, the expense for publication of the public technical gazette will be about an eighth of that for an application of the patent, so that it is expected that the expense for managing the patent right in companies will be reduced.
Internet Confirmation Service Regarding Patent Examinations From now, it is possible for the applicants to recognize when the result of their own research will be examined.
Therefore, the curiosity for the progress of the examination for which the period of 10 to 36 months has been required will be able to be settled sufficiently.
It was announced that KIPO will start an internet service to inform of the examination schedule regarding the applications of the standby status for a long period.
At present, the applications which are waiting for examination have reached a considerable number, so that the period for the examination will be about 30∼36 months in the case of the patent and the utility model, about 17 months in trademarks and about 10 months in design patents.
Owing to this service, it will be possible from September to confirm the prearranged date of the examination commencement only by inputting the application number.
It will be possible to search easily for the progress of other applications which have been opened to the public.

Simplification Of The Verbal Trial Procedure

The Industrial property Tribunal has prepared and begun to enforce "a plan promoting efficiency of the Verbal Trial" in order to raise the quality of patent judgements by carrying out an exact fact finding and a speedy settlement regarding the patent judgement cases.
In the previous system, the notice for the verbal trial date should be carried out in writing by one month prior to an appointed day.
However, in the new system for simplification of the verbal trial procedure, it is possible to be informed of the the verbal trial date a week prior to an appointed day and can be informed by telephone, facsimile or telegram.
Meanwhile, the party concerned should present an abstract of the verbal trial statement and a list of evidence three days prior to the appointed day.
