Examination Standard for Trademark and Design to be revised greatlyThe judgment standard for the similarity of trademarks having the form of a domain name (internet address) and three dimensional- trademarks will be newly established and the examination standard will be greatly revised.
KIPO complemented the current examination standard related to the one application system for many classes in the design, three dimensional-trademark system, non-examination system for a part of design and so on, and prepared 『a Proposal of Examination Standard for Trademark and Design』 in order to ensure objectivity and fairness of each examination.
It is reported that KIPO will take opinions from applicants and related organizations, for example, the Korean Patent Attorneys Association and the Korea Invention Promotion Association and enforce it from July.
In this proposal, KIPO newly established the examination standard of similarity for the domain name and three dimensional-trademark and for the combination of indiscriminate marks in the case of trademark.
According to the proposal, if a design may be detrimental to the international trust relations and the fair competition order, the design will not be granted to be registered.
Evaluation For the Publication of the Patent Official Gazette in CD-ROM FormIt is estimated that expenses for publication and custody of the official gazette has been reduced by virtue of CD-ROM form publication of the patent official gazette during its first year.
In the old-style official gazette book, it was difficult to search for technical information because information had been described in order of publication in the book.
On the other hand, in the CD-ROM format of the official gazette, it is possible to easily search for information by using various kinds of search means, for example IPC, applicant, application number and key words.
As a result, it enables the examiner to become aware of the subject matter of techniques in the same field within very short time, e.g. one forty-fifth the time of prior search times.
Also, KIPO plans to convert information of all patents and utility models of its 630,000 cases to SGML fulltext by the end of the year 2000.
Internet Homepage of KIPO to become a Cyber Patent NewsletterKIPO plans to make up an internet homepage known as the "Cyber Patent Newsletter" like a newspaper for the sake of the patent related business world by diversifying the menus of its internet homepage and adding search functions.
At present, the number of access to the internet homepage of KIPO reaches two thousand two hundred every day (http://www.kipo.go.kr) and particularly people engaged in patent business obtain information through the internet homepage of KIPO everyday.
Accordingly, KIPO planned to supplement the homepage in order to provide the improved service.
To improve its quality of service, KIPO will add functions for searching a variety of data and functions for providing the technical information of the membership system to the present internet homepage.
This work will be completed by November, and KIPO decided to call this homepage the Cyber Patent Newsletter.
