Problems were discovered in Korean patent network.The Korean Industrial Property Office entrusted the analysis of informationalized state to the James Martin Company to understand an informationalized state of patent administration.
As a result, it was discovered that civil convenience, business transactions and international position improved by using a patent network, on the other hand, there was a lot of improvement needed.
Concretely, lots of data errors existed in the data field of patent networks.
The Martin Company analyzed that productive reinvestment related to maintenance management and business improvement was not carried out smoothly because half of the manpower had to exchange and amend data errors.
Also, the Martin Company pointed out that a lowering of system rates meant a lowering of convenience and so on.
Further, they proposed the strengthening of security and the establishment of a monitoring system.
A「Dispute mediation committee」for domains will be established.The Information Tele-communication Department announced that they would establish a「dispute mediation committee」to settle disputes about domestic domain(.kr).
The IT Department decided to establish this committee due to the increase of disputes about trademark rights related to internet domain recently.
A newly established「dispute mediation committee」will be composed of experts relating to internet domain and intellectual property right, and plan to take less time and expense compared to a judicial procedure.
Registered domestic domains took fourth place in the world with about 450 thousand cases, and many disputes are being accepted.
Also, the Information Communication Department plans to search domains in advance by connecting a trademark search DB of KIPO and domain registration system of Korean Internet Information Center to prevent any disputes about the domain name.
A person's name is used as a trademark of food.The name of a founder or a well-known person was used as the name of goods in food companies.
In the case of「Kang sung-won milk」, the name of a founder was selected as a trademark.
The wine shop of「Bae sang-myoun」also used the name of a founder.
Nam-yang dairy company is using the name of well-known person of 「Einstein」, Birak is using「Edison milk」, and Han-kook yogurt is using 「Mechinicoff」.
Also, 「Joo jae-keun Bakery」of a bakery company is using the name of a founder as it's company name.
As a result, there is an increase in the name of a specific person used as a trademark.
Revised patent attorney examination is advantageous to officials of KIPO.Patent attorneys said that a revised patent attorney examination would be advantageous to the officials of KIPO when they took a patent attorney examination.
Also, candidates for the patent attorney insisted that to relatively evaluate in the 1st examination and absolutely in the 2nd examination must be advantageous to officials of KIPO who take only the 2nd examination.
As for this, KIPO announced that the 1st examination would also be absolutely evaluated .
The abuse of BM patents will be strictly controlled .
From now on, BM patent abuses will be controlled and a watch system for the internet will be established to prevent fraudulent sales in electronic commerce.
